Recently, the Intermediate People’s Court of Jining City, Shandong Province made a final judgment on 19 defendants, sentenced Yun Huan to 13 years in prison for the crime of producing and selling counterfeit drugs, and fined him 3 million yuan. Deng Hewu was sentenced to 11 years in prison for producing counterfeit drugs and fined 500,000 yuan; Ma Jiayi was sentenced to 11 years in prison and fined 2.6 million yuan for selling counterfeit drugs. The other 16 defendants were sentenced to fixed-term imprisonment ranging from one year to six years, and fined ranging from 20,000 yuan to 300,000 yuan.

At the beginning of March, 2016, Ms. Wang, a citizen of Jining, saw her friend Kan Lihong selling a slimming product called pure Chinese medicine in the WeChat "circle of friends", so she spent 2,400 yuan to buy 10 boxes, and also wanted to make a little money in Wechat business business. With a lingering fear, she took the slimming capsule to the Jining High-tech Zone Public Security Bureau to report the case. After receiving the report, the public security organ attached great importance to it, and immediately sent this slimming product for inspection. According to the experience, the slimming capsule contains sibutramine, which is forbidden to be produced and sold in China by the state, and is recognized as a counterfeit drug.
On May 13, 2016, the Public Security Bureau of Jining High-tech Zone launched an investigation into this case of suspected production and sale of toxic and harmful food. After investigation, it was found that the case involved many provinces and places, and the local police worked together to arrest and criminally detain 19 major suspects.
All 19 people who arrived at the case confessed to the facts of the crime. Yun Huan, one of the main suspects in this case, was only 23 years old when she was brought to justice, but it was through her overall arrangement that counterfeit drugs formed an organized and large-scale interest chain from production to sales.
When the prosecutor in charge of the case was brought to trial, Yun Huan showed great remorse. As an agent in Wechat business who has worked as a diet pill before, Yun Huan knows the vast market demand of this product and has many ready-made customers at hand, so she decided to start with the familiar diet products. Since October 2015, Huanhuan has fabricated the manufacturer, copied the appearance of the diet pills previously represented, found someone online to design the outer packaging and drug instructions, and sent them to Hong Wei, a Guangdong manufacturer engaged in printing and packaging business through online contact, who is responsible for the packaging of the products. Later, Huanhuan contacted Deng Hewu and others from the Internet to buy a large number of slimming capsules, and asked them to deliver the slimming capsules directly to Hong Wei.
Deng Hewu found a fellow countryman to help with powder filling and processing to produce capsules. In order to achieve the effect of losing weight, sibutramine, a contraband that has a slimming effect but is obviously harmful to human health, was added. On the other hand, Hong Wei printed the product packaging, drug instructions and other items, bought medicine bottles online, bottled and packaged the weight-loss capsules received, and a complete assembly line for producing counterfeit drugs was formed.
The slimming capsule has been produced, and the next step is to let it enter the market quickly to gain benefits. Hearing that Yun Huan has become a "brand founder", Ma Jiayi offered to be a "director" agent to help him explore the market. Because this slimming capsule is produced with the gimmick of pure Chinese medicine to lose weight green, claiming that it is absolutely harmless and has no side effects, the product has just entered the market, and it has ushered in a good sales start, and the addition of Ma Jiayi has made the brand quickly popular in the "Wechat business" circle. Many customers who want to rely on drugs to lose weight easily believe these "Wechat business" advertisements, and a large number of orders poured in at one time.
Crazy development offline, half a year to collect money up to 10 million

Kuaihuan and others, who are at the top of the pyramid, are a little panicked, but in order to seek benefits, they don’t stop there. Yun Huan, together with several "director" level agents, began to show up for a large-scale "rumor". Knowing that the product had problems, on the one hand, she privately used a refund to appease a small number of customers who were in serious condition, on the other hand, she trumpeted the phenomenon that some Chinese medicine ingredients in her product would cause dry mouth. When the lower-level agents asked if the product had relevant documents such as national drug inspection, she unanimously responded that they were all being processed, and insisted that slimming capsules were food-grade drugs.
Kuaihuan knows that paper can’t cover fire, and if you don’t make adjustments soon, things will be exposed sooner or later. During this period, she did two things. The first thing was to find Ma Jiayi privately to discuss not making drugs and selling slimming juice, and bluntly said that making juice was to clear the relationship with "medicine". However, Ma Jiayi did not realize that the "storm" was coming soon in the voice of external doubts. The second thing is to ask Deng Hewu why the side effects of slimming capsules are getting worse and worse. She said, "Now there is a female teacher who vomited all day and went to the hospital by herself. The doctor said that the lack of potassium is due to slimming drugs. This is terrible and she has to lose money." Deng Hewu asked that this batch of goods be placed and returned to the packaging factory to give him the loose capsules. But at that time, 900,000 slimming capsules had all been sold out.
I thought this questioning storm would soon pass, but I didn’t expect a wave of unrest to rise again and again. Ma Jiayi’s off-line Kanlihong’s Wechat business business caught Ms. Wang’s attention. Finally, after Ms. Wang tried the medicine herself, she felt unwell and chose to report the case, and everything was discovered. In this short period of six months, Yun Huan, Ma Jiayi and others have collected nearly 10 million yuan by developing off-line sales of counterfeit drugs.
A small slimming capsule involved 19 suspects from production to sales. In May 2016, the Procuratorate of Jining High-tech Zone successively approved the arrest of several suspects suspected of producing and selling counterfeit drugs. After prosecution by the Procuratorate of High-tech Zone, on October 16 of the same year, the court of Jining High-tech Zone made a first-instance judgment on 19 defendants, including Yun Huan, for the crime of producing and selling counterfeit drugs. Four defendants, including Yun Huan, Deng Hewu and Ma Jiayi, were each sentenced to more than 10 years in prison, and the other 15 defendants were sentenced to penalties ranging from one year to seven years. After the verdict was pronounced in the first instance, Yun Huan and others refused to accept the verdict and appealed in court.
On January 15, 2017, after a public hearing by the Intermediate People’s Court of Jining City, a final judgment was made on the case of 19 people, including Yun Huan, who produced and sold counterfeit drugs according to law, reducing some fines and the main punishment of individual accomplices, while the rest maintained the first-instance judgment. This case of counterfeiting and selling fakes with a wide range, a large amount of money involved and extremely bad influence finally came to an end.
Zhu Xinqing, the prosecutor of Jining High-tech Zone Procuratorate, who undertook the case, said that behind this case, people saw the story of a young woman with a keen business mind who was lured into the whirlpool of greed by money and eventually accompanied by high walls and bars. To engage in activities in Wechat business, we should be sincere, and don’t move any wrong ideas, otherwise we may be on the road of breaking the law and committing crimes. At the same time, as ordinary consumers, we should improve our ability to distinguish the authenticity of goods in the market and not listen to others’ words easily; Once losses occur, we should learn to take up legal weapons to defend our legitimate rights and interests.
